Terms for estate agents

These terms apply to estate agents and developers who show their properties on Heimweit. Heimweit is a service of:

1. What this is about

Heimweit shows properties to German-speaking buyers on heimweit.de and in the Heimweit app. You deliver your listings as a feed from your agency software, for example as an OpenImmo export to our FTP server or as a Kyero feed. With the first transfer, you take part under these terms.

2. Costs

Taking part is free during the launch phase. If that changes, we will tell you by email at least 30 days in advance. Taking part only becomes chargeable if you expressly agree.

3. What we may do with your listings

For as long as you take part, you grant us the simple, non-exclusive and free right to store the content you deliver (texts, photos, floor plans, key data), to translate it into German and other languages, to shorten it, to present it in a uniform way (for example resizing images or converting prices to euros) and to show it on heimweit.de, in the app and in notifications to buyers.

Outside Heimweit, for example in advertising, we only use your listings with your consent. We do not pass them on to third parties, except technical service providers working for us.

4. Your commitments

You may pass on the content you deliver; in particular, you hold the necessary rights to photos and texts and the mandate to market the property. The information is correct to the best of your knowledge. You remove sold or withdrawn properties from the feed.

If third parties bring claims against us because of content you delivered, you help us defend them and indemnify us to the extent that you are responsible for the infringement.

5. Presentation

Your listings always appear with the name of your agency and a link to the original listing. Translations are produced automatically with the help of AI and are marked as translations; your original prevails. There is no right to have a particular listing shown or shown in a particular place.

6. Enquiries from buyers

We forward enquiries about your listings directly to you by email, with a translation if needed. Heimweit is not an estate agent, does not become a party to any purchase or agency contract and does not charge buyers a commission.

7. Ending

You can stop taking part at any time without notice: stop the transfer or send a short email to kontakt@heimweit.de. We will then remove your listings within 7 days. We can also end your participation at any time; we will let you know beforehand.

8. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise we are only liable for breach of essential obligations, limited to the foreseeable, typical damage. We do not guarantee that heimweit.de and the app are always available.

9. Data protection

We use the contact details of your agency and your contact persons to manage your participation and forward enquiries. Personal data in your listings, such as the name of a contact person, is shown as you deliver it. More in our privacy policy.

10. Changes to these terms

We announce changes by email at least 30 days in advance. If you do not object and keep transferring, the new terms apply; we point this out in the email. If you object, either side may end the participation.

11. Governing law and jurisdiction

German law applies. To the extent permitted by law, the place of jurisdiction is the registered office of Digital First UG (haftungsbeschränkt). These terms exist in several languages; the German version prevails.
